App Terms of Use (EULA)

Acceptance of terms

These Terms of Use, which also serve as the End User License Agreement ("EULA" or "Terms"), are a legal agreement between you and LoTime Inc. ("LoTime," "we," "our," or "us") governing your use of the LoTime mobile app for iPhone (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

License to use the app

Subject to these Terms, LoTime grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, as permitted by the Apple Media Services Terms and the Usage Rules in the Apple App Store guidelines.

Eligibility and accounts

You must be at least 13 years old to use the App. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Upload or share content that is illegal, infringing, harmful, harassing, hateful, or sexually exploitative
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law

Your content

You retain ownership of the photos, posts, and other content you create in the App ("User Content"). You grant LoTime a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate and provide the App and its features. You are responsible for your User Content and represent that you have the rights necessary to share it. We may remove content that violates these Terms.

Zero tolerance for objectionable content and abusive behavior

LoTime has a zero-tolerance policy for objectionable content and abusive users. You may not create, upload, post, or share content, or engage in conduct, that is objectionable, including content that is illegal, obscene, pornographic or sexually explicit, hateful, defamatory, harassing, bullying, threatening, violent, or that promotes discrimination, self-harm, or harm to others.

To keep the community safe, we provide the following safeguards, and by using the App you agree to use them as intended:

• Filtering: we take reasonable measures to filter and moderate objectionable content posted in the App.
• Reporting: you can flag or report objectionable content directly in the App, or by emailing support@lotime.com.
• Blocking: you can block abusive users so you no longer see their content or receive contact from them.

We act on reports of objectionable content and abusive behavior, including by removing the content and ejecting the user who provided it, within 24 hours of receiving a report. We may also suspend or permanently terminate accounts that violate this policy, at our sole discretion and without notice.

Auto-renewing subscriptions

The App is free to download and includes 24 shots per day. We also offer optional auto-renewing subscriptions that unlock additional shots and features:

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription automatically renews for the same period at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renew, in your device Settings → your name → Subscriptions after purchase. Cancelling takes effect at the end of the current billing period.
• Prices are stated in U.S. dollars and may vary by region; any price changes will be disclosed to you in advance as required by the App Store.
• Refunds are handled by Apple in accordance with the App Store terms. To request a refund, visit reportaproblem.apple.com.

Account deletion

You may permanently delete your account and your content at any time from within the App (profile settings → Delete Account), or by emailing support@lotime.com. Deleting your account does not automatically cancel an active subscription — manage subscriptions through your Apple ID as described above. See our App Privacy Policy for details on data handling.

No confidential communications

Except as otherwise set forth in our App Privacy Policy and by law, support messages, feedback, reports, or other communications you send to LoTime are not privileged or confidential and may be used to operate, support, improve, and develop the App.

Intellectual property

The App, including its software, design, logos, and content (excluding User Content), is owned by LoTime or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

You may not copy, modify, or use LoTime branding, software, or other protected App materials except as these Terms expressly permit. Unauthorized use may violate state or federal law and may subject you to enforcement actions.

Assumption of risk and data protection

By accessing or using the App, you assume the risks associated with that use and with actions taken as a result of that use. The App is hosted and maintained with support from external, unaffiliated service providers, and reasonable measures are used to safeguard against data breaches, unauthorized access, and operational failure.

LoTime makes no warranty or representation concerning the safety or security of anyone's use of or access to the App, except to the extent required by law.

Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, LoTime shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of the App.

Apple App Store — additional terms

These Terms are between you and LoTime only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content. The following additional terms apply to your use of the App obtained through the Apple App Store. To the extent of any conflict, these terms control over other provisions of this EULA for App Store downloads, and Apple's standard Licensed Application End User License Agreement also applies.

• Scope of license: the license granted is limited to a non-transferable license to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
• Maintenance and support: LoTime, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish maintenance or support.
• Warranty: LoTime is solely responsible for any product warranties, whether express or implied. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation with respect to the App.
• Product claims: LoTime, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims.
• Intellectual property: in the event of a third-party claim that the App infringes intellectual property rights, LoTime, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

Third-party services and links

The App may provide links or access to third-party services. Except as specifically stated, LoTime does not sponsor or endorse those third-party services and does not warrant or guarantee their goods, services, privacy practices, or terms. Your use of third-party services is subject to their own terms and policies.

Changes to these terms

We may modify these Terms from time to time. Changes are effective when posted here with an updated "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except that the foregoing does not limit any mandatory consumer protection rights you may have under the laws of your place of residence.

Non-waiver and severability

Any waiver by LoTime of a violation or non-compliance with these Terms shall not operate or be construed as a waiver of any other violation or non-compliance. If any part of these Terms is held invalid or unenforceable, the remainder of that provision and all other provisions shall remain in full force and effect to the greatest extent allowed by law.
